These Terms of Service ("Terms") govern your access to and use of TripNoted's website, applications, and services (collectively, the "Service"). By accessing or using TripNoted, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

TripNoted is an AI-powered travel organization service that connects to your email to automatically extract and organize travel-related information including flights, hotels, restaurants, and activities into unified trip itineraries.

The Service includes:

• Gmail integration for automatic travel data extraction
• AI-powered trip organization and itinerary creation
• Trip management and viewing features
• Access via web application at app.tripnoted.com

To use TripNoted, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access to your account

You must be at least 16 years old to create an account and use the Service.

By connecting your Gmail account to TripNoted, you authorize us to:

• Access and read emails that match travel-related patterns
• Extract booking details, confirmation numbers, dates, and locations from those emails
• Store extracted travel information to provide the Service

You understand and agree that:

• TripNoted only accesses emails identified as travel-related
• You can revoke Gmail access at any time through your Google Account settings
• Revoking access will stop new data extraction but won't automatically delete previously extracted information
• Our use of Google data is governed by Google's API Services User Data Policy

Pricing

TripNoted offers the following subscription options:

• Annual Plan: $19 per month, billed annually ($228/year)
• Monthly Plan: $29 per month, billed monthly

Billing

• Payment is charged at the beginning of each billing period
• Annual subscriptions are charged in full at the start of the subscription year
• Prices are in USD and exclude applicable taxes

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods or unused time
• You retain access to the Service until the end of your paid period

Price Changes

We may change subscription prices with 30 days' notice. Price changes will apply to the next billing period after the notice period.

You agree to use TripNoted only for lawful purposes. You may not:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any commercial purpose without our written consent
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems or software to extract data from the Service
• Share your account credentials with others or allow others to access your account
• Upload or transmit viruses, malware, or other harmful code

Our Rights

TripNoted and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

Your Content

You retain ownership of your personal data and any content you provide to the Service. By using TripNoted, you grant us a limited license to use, process, and display your content solely to provide the Service to you.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Travel information extracted from emails will be complete or accurate
• The Service will meet your specific requirements
• Any errors in the Service will be corrected

Important: TripNoted is a travel organization tool, not a travel booking service. Always verify important travel details directly with airlines, hotels, and other service providers. We are not responsible for missed flights, incorrect reservations, or any issues arising from reliance on information displayed in TripNoted.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPNOTED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless TripNoted and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you provide through the Service

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms.

You may terminate your account at any time by contacting us. Upon termination:

• Your right to access the Service immediately ceases
• We may delete your account data, subject to our data retention policies
• Provisions of these Terms that should survive termination will remain in effect

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco, California.

You agree to first attempt to resolve any disputes informally by contacting us. If a dispute cannot be resolved informally, you agree to binding arbitration under the rules of the American Arbitration Association. You waive any right to participate in class actions or class arbitrations.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

• Entire Agreement: These Terms constitute the entire agreement between you and TripNoted regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
